In an example previously posted on the website, it was stated that diabetes test strips did fall within the definition of “device” as mitigating disease. In response to numerous inquiries, the example was further reviewed and revised and on March 5, 2014, the College made the following update:

Are glucose meters and diabetes test strips included in the prohibition of providing incentives?
Last December, the College received over 14,000 emails from the public overwhelmingly opposed to ending the practice of providing a kickback to customers in exchange for their prescriptions. After careful consideration, the College still firmly believes that paying patients for prescriptions is unprofessional, unethical, and unsafe. The College is dedicated to ending this practice.
In the September 21, 2012 Board meeting the Board approved in principle, for public comment, the revised Bylaws. Those bylaws were then posted for public comments during the Fall of 2012. After the public commenting period ended on December 28, 2012 the College reviewed, analyzed, and presented the comments to the Board for their consideration.
