Duties to Report Licensees

Duties to Report LIcensees

All licensees regulated under the Health Professions and Occupations Act have a duty to make a report to the regulatory college of the designated health profession of another licensee, if one or more of the following applies:

  • The other licensee has been admitted to a health facility
  • There are reasonable grounds to believe that the other licensee is not fit to practise
  • There are reasonable grounds to believe that the continued practice of the designated health profession by the other licensee presents a significant risk of harm to the public
  • There are reasonable grounds to believe that the other licensee has committed an act of sexual misconduct, sexual abuse, or discrimination

 

This means that if a licensed pharmacy professional has reasonable grounds to believe any of the above, they have the duty to report this regardless of whether the other licensee (other regulated health practitioner) is from their own profession or a different regulated health profession.

The Health Professions and Occupations Act provides immunity to licensees who makes a report that they are required to make. This means that no legal proceeding for damages lies or may be commenced against a licensee who makes such a report, if the report was made in good faith and was based on reasonable grounds.
