Health Professions Act (HPA) Updates
Proposed Draft Revised Bylaws for Public Comment
The College Board approved in principle, for public comment, the revised Bylaws at their regularly scheduled Board meeting held on November 20, 2009.
The proposed revisions to the Bylaws are highlighted in the attached documents with the vast majority of the revisions pertaining to the ‘regulation of pharmacy technicians’. (note: given the extent of the amendments required to recognize pharmacy technicians, this proposal is for a complete ‘repeal and replace’ of the Bylaws not just the highlighted changes.)
The initiative to regulate pharmacy technicians on a voluntary basis has been a strategic objective of the College for many years and the regulation process, which is aligned with the national model, will result in the establishment of a new ‘registrant’ under the College of Pharmacists of BC. As a College ‘registrant’ pharmacy technicians are under the same legislation (i.e.: HPA, PODSA, Code of Ethics etc.) as pharmacists.
The College Board has established a Pharmacy Technician Task Group, with pharmacist and technician representatives from a wide variety of practice settings, to oversee the development, implementation and evaluation of regulated technicians.
Detailed information regarding the regulation of pharmacy technicians can be found on the College website (www.bcpharmacists.org) under Key Initiatives: Pharmacy Technician Regulation.
For ease of reference those sections highlighted in the revised Bylaws perceived to be most significant to the regulation of pharmacy technicians have been identified below however, individuals are advised that they should read the document in its entirety prior to posting comments.
HPA Bylaws:
s.2 – Composition of Board
s.47 – Pharmacy Technician Registration
s.55 - Quality Assurance Program
s.81 - Liability Insurance
Schedule F – Standards of Practice
Part 1 – s.4 – Community Pharmacy Standards of Practice*
Part 2 – s.10 – Hospital Pharmacy Standards of Practice*
Part 3 – s.5 – Residential Care Facilities and Homes Standards of Practice*
*with respect to ‘receiving verbal prescriptions from practitioners’ the College Board has approved a recommendation (June 2009) that further guidelines be established.
Comments on the draft Bylaws should be submitted to the College of Pharmacists of BC by April 30, 2010. Comments may also be forwarded to the Ministry of Health Services.
